1. Who we are and acceptance of these terms

These Terms & Conditions govern your use of the Simific website and mobile application and the purchase of services through them (together, the “Service”). The Service is operated by ASIAN GROUP DISTRIBUTOR DI KHATUN SOKHINA, Via Terrazzini 5, 57122 Livorno (LI), Italy, P.IVA / VAT 02030760496, REA LI-227025 (“we”, “us”). By using the Service or placing an order you agree to these terms. If you do not agree, please do not use the Service. Full operator details are in our Legal Notice.

2. The Service

Simific offers travel connectivity, currently eSIM data plans, and may add other travel services such as hotels, buses, trains and car rentals. Where a service has its own conditions, they are shown with that service and apply in addition to these terms.

3. Your account

You must provide accurate information when creating an account and keep your login credentials confidential. You are responsible for activity under your account. You must be at least 18 years old to place an order. Tell us immediately if you suspect unauthorised use of your account.

4. Orders, prices and payment

• Prices are shown before you confirm your order, in the currency displayed, and include applicable taxes unless stated otherwise.
• An order is accepted when we confirm it and deliver the purchased service or the necessary activation details.
• Payment is processed by third-party payment providers. We may refuse or cancel an order where we suspect fraud or an error in pricing or availability, and we will refund any amount paid.

5. eSIM delivery, compatibility and use

• eSIMs are delivered digitally, usually within minutes, through your account, email or the app.
• You are responsible for checking that your device supports eSIM and is network-unlocked before you buy.
• Data plans are valid for the duration, data allowance and region shown at the time of purchase. Unused data expires with the plan and is not refundable or transferable.
• Coverage, speeds and availability depend on local mobile networks and are not guaranteed. Voice calls and SMS are not included unless the plan says so.

6. Right of withdrawal and refunds

Because eSIMs and other digital content are delivered immediately, the statutory right of withdrawal may not apply once delivery has started with your consent. The details, and when you can obtain a refund, are set out in our Refund Policy, which forms part of these terms. Nothing in these terms limits your mandatory rights as a consumer.

7. Acceptable use

You agree not to:

• use the Service unlawfully or to commit fraud;
• interfere with or attempt to gain unauthorised access to the Service or its systems;
• resell or redistribute plans without our written permission;
• use the Service in a way that harms networks or other users.

We may suspend or terminate access where you breach these terms or the law.

8. Third-party providers

Some services are provided together with third-party partners such as mobile network operators and travel suppliers. We are not responsible for interruptions or limitations that originate in their networks or systems beyond what the law requires.

9. Intellectual property

The Service, including its design, text, logos and software, belongs to us or our licensors and is protected by law. You receive a personal, non-exclusive, non-transferable right to use the Service for its intended purpose.

10. Liability

Nothing in these terms excludes or limits liability that cannot be excluded by law, including liability for intent, gross negligence, or death or personal injury. Subject to that, and to your rights as a consumer, we are not liable for indirect or consequential loss, loss of profit, or loss of data, and our total liability for a claim relating to an order is limited to the amount you paid for that order.

11. Changes to the Service and these terms

We may update the Service and these terms from time to time. Changes apply to orders placed after the update, and we will notify you of material changes where required. Continued use of the Service after a change means you accept the updated terms.

12. Governing law and disputes

These terms are governed by Italian law. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence and may bring proceedings before the courts of your place of residence.
